and out of date. i'm steve handelsman, news4. there's a new poll out that suggests mitt romney's strong debate performance last week has improved his standing in the presidential race. the pew research center shows romney leading president obama among likely voters by a margin of 49% to 45%. three weeks ago, that same poll gave president obama an 8-point lead. today the united nations secretary-general said the violence in syria is threatening the stability of the region. activists say the civil war has claimed more than 30,000 lives since it began last year, and the violence has spread beyond the borders. syrian mortars have landed in turkey. for six straight days turkey has launched retaliatory strikes. and warned syria not to test his resolve. he said turkey is ready for war. posters considered so controversial they might incite violence are now hanging in

several metro stations. news4's jackie bensen is at the u street station with reactions from riders and from the woman who is behind this campaign. >> reporter: well, the judge ordered the posters to be installed by 5:00 this evening. and it looks like that deadline has been met. the campaign's creator says it's a matter of free speech. >> i will not sacrifice my freedom of speech so as not to defend savages. it's utterly unamerican. >> reporter: sandwiched between two newly cleaned sheets of plexiglas on the platform of the u street metro station is the result of a court battle that included consideration of events happening halfway around the world. a group called the american freedom defense initiative, sued last month for the right to display the ads in the metro system. they read, in any war between the civilized man and the savage, support the civilized man. support israel. defeat jihad.

the transit agency initially resisted the poster campaign, which some view as anti-muslim. because it coincided with an outbreak of deadly violence in the middle east over an unrelated anti-muslim video on the internet. citing free speech concerns, a u.s. district judge said the posters would go up by 5:00 p.m. today. a grou of college students were among the first to see it. >> i study arabic and i think they're using jihad incorrectly. it means struggle, not blow things up. >> i definitely agree with freedom of speech working in the media, but i think you have to be conscious of how you're representing cultures. >> reporter: some posters in the new york subway system have been vandalized. >> it's savagery, and calling attention to savagery is not hate, it's love. >> reporter: the controversial posters have been installed in the u street, georgia avenue, tacoma, and glenmont stations.

jackie bensen, news4. there is yet another death linked to a deadly meningitis outbreak. the centers for disease control said 105 people have been made sick by a rare fupg al infection. peopeight are dead. two of those were in maryland and virginia. health officials have linked the outbreak to steroid shots used for back pain. the shots were made by a specialty pharmacy in massachusetts. the cdc is telling doctors to stop using any drugs made by that pharmacy. this form of meningitis is not contagious. right now, we have new information about a body that was found this afternoon in a fairfax park. volunteers discovered the body in the woods in thaiss park today when they were searching for the 17-year-old student, bryan glenn. just moments ago police told news4 they did in fact search this area last week but they must have missed the body. they've not positively

identified the body found this afternoon. but they are still determining the exact cause of death. sources are telling news4 that at this point, they do not believe it to be a suspicious death. a woman accused of operating an unlicensed day care in her home in manassas, virginia, is now facing three new charges of child abduction. her name is tara loop. she was arrested last week. today, authorities said they added the abduction charges after learning that she actually had nine children in her home, not the six they originally thought. she allegedly moved three of the children to a neighbor's house before the police arrived, and she did that without the parents' permission. all of those kids were under the age of 4. it looked like the threat of a strike at pepco, it's over. the power company and union reached a tentative deal on a new contract. union members still need to vote on it, but their president is urging them to approve it. it covers four years, but no other details have been revealed. the previous offer was rejected

5-1 in a vote last month. police shot and killed a man this morning in silver spring, maryland. it happened right outside a house where the man's girlfriend was working as a nanny. pat collins is at the montgomery county police headquarters now in rockville with more on this. pat? >> reporter: jim, this looks very much-li like a case of suie by cop. >> there were a number of shots. they were in swift success. >> reporter: how many shots? >> like maybe eight or nine. it was a lot of them. >> reporter: a man on an apparent self-destructive path, shot and killed this morning by police behind this house in silver spring. now, it's unclear as to what drove him to do what he did. but alcohol may have played some role. police say he brought a large odka to what turned out to be the scene of his death. 3:15 a.m., a 911 call to police

from a 22-year-old man. he said he wanted to die, that he had a gun. and he said more than that. >> at times he stated he wanted to kill himself, at other times he stated he wanted the police to kill him. >> troubling? >> absolutely. >> reporter: 3:17 a.m., police trace that call and end up at this house on woodland drive in silver spring. they find that man near a back stairwell of the house. they start talking to him, trying to get him to drop what appears to be a gun. inside the house, a woman identified as the man's girlfriend, she works here as a nanny. she's caring for three children, her own son and two other kids. police move them all to an ambulance outside for their safety. 4:50, police called neighbors and warned them of potential trouble. this woman describes what that was like. >> the lady said, it's a confidential situation that's going on on your street. you need to stay in the basement

until further notice. >> reporter: 5:03 a.m., the man walks out of that stairwell. there's a confrontation, and he's shot by police. >> turns out it's a replica gun? >> it is a replica gun. >> does that make a difference? >> it doesn't make a difference. when you present us with a gun, whether it's real or not real, looks real, we're going to take action. >> reporter: now, the dead man has been identified as tracy woodfork from bladensburg, maryland. live in montgomery county, pat collins, news4. it got chilly out there. it is nearly 30 degrees colder today than it was saturday. and boy, it looked like it outside. people are dressed up like winter. bundled up as they went about their day. others get a nice swim in this heated pool in bethesda. not only was the lifeguard bundled up, she had a heater going there. who can blame her. storm team 4 chief meteorologist doug kammerer joins us now with more on the conditions.

tensions are up along the gaza strip after a new series of attacks between israeli forces and palestinian militants. the militants say this video shows their rockets launched toward israel.

the islamic group hamas said one of the rockets hit a children's petting zoo. two goats were killed but no children were hit. the palestinians say the attacks are in retaliation for a deadly air strike by israel yesterday. it is the most serious dispute along gaza in four months now. indonesia, take a look at this giant cloud of ash from a volcano that erupted there. witnesses say it sounded like thunder. no report eveof injuries so far. they're urging people to stay inside to avoid that ash. it erupted more than 40 times since the beginning of september. two controversial discoveries earned scientists the nobelrize p in medicine today. john gurdob and shinya yamanaka said mature cells can be turned into new tissue. the nobel committee said they

revolutionized the understanding of how cells develop. scientists are now using their research to treat diseases, including par kin sons and diabetes. big celebrations today in venezuela following the re-election of hugo chavez. the controversial leader is set to rule that oil-rich country for another six years. but as nbc's carey sanders reports, opposition by his own people is stronger than ever. >> reporter: fireworks filled the skies. as the street fight continued well into the early morning hours. a chavez victory say supporters means his brand of socialism is here to stay. >> we're living socially. >> reporter: hugo chavez, 58 years old, a star among the poor in south america, was himself surrounded by a hollywood star sunday, actor danny glover. a chavez supporter. for almost 14 years, the

miles an hour. anytime we see a little bit of a breeze, it's going to help to make it feel even cooler. temperatures, already in the 40s. low 40s as a matter of fact. winchester at 41. 43 in martinsburg. 46 right now in gaithersburg. this is why, not only has it been cold back here, it's been raining most of the day. most of it has been on the light side, but fairly steady in parts west of the blue ridge. east of the blue ridge, we've seen the cloud cover, but most of us have stayed fairly dry. you can see a couple of showers in through southern maryland, but that's about it. but this is all moving to the east. so we will see some fairly light steady rain throughout much of the rest of the evening, into the overnight hours. right now, it's raining in winchester, luray, front royal, warrenton, gainesville and leesburg and now moving into portions of montgomery county, around the clarksburg area, and

frederick county. you'll continue to see the light showers. not only will you need the jacket tonight, but most likely you'll need the umbrella, maybe even the rain boats the rest of the evening. this is all part of a storm system driving through the region. that is going to help to create more showers for us. the strongest storms have been down to the south. we've seen a lot of thunder and lightning through the norfolk area and eastern north carolina. the storm continues to move off to the eastern portions of the atlantic. or rather, western portions of the atlantic ocean. 47 in hagerstown. you can see the cold air just sitting on top of us. it is going to stay here overnight tonight. the area of low pressure moves up the coast and gives us cool air tomorrow with a northeasterly flow. that will allow not only for cool conditions, but maybe fog and drizzle tomorrow morning. showers through portions of southern maryland, but most of us should start to dry out and start to clear out by late in the day tomorrow. so tomorrow, a little bit nicer. by wednesday, i think we're

with his family. >> he disappeared last friday when the woman walking hirm was assaulted in northeast washington. he's a bit banged up, when he was found, but as darcy spencer reports, the vets say murray's going to be fine. >> reporter: he's walking with a limp, because of a dislocated elbow he suffered after being hit by a car. but murray, the focus of a massive search, is doing much better now. now that he's been found and has been reunited with his family. >> he's okay. he's just at the doctor's office. >> reporter: murray got loose last week. beth kemler was walking him when a jogger claimed murray bit him. the man grabbed murray's leash, he slipped out of his collar and took off. murray was gone. kemler said the jogger came back, sexually assaulted her and grabbed her arm so hard, you can still see the bruises. >> my wounds aren't anywhere near what murray's are. but yeah, i do still have a pretty bad bruise on my arm. but it will heal.

>> reporter: kemler mounted a campaign to get murray back on facebook and twitter. friends and volunteers posted fliers all around the city and it paid off. a tip led animal control officers to rhode island avenue in northwest sunday. the lost and lonesome dog was found in someone's backyard. >> it feels amazing. i woke up yesterday and i really -- i didn't -- i just had this sinking feeling. i didn't think we were going to get him back. >> reporter: murray is recovering at the friendship family hospital which is giving the owners a break on the medical bill. doctors here say murray is definitely banged up but he is going to be okay. but will have to stay here at the hospital for a couple of days before he can go home. doctors say besides the dislocated elbow, he has burns, cuts and scrapes. >> not to have any chest wounds, or any lung contusions, any heart problems, he's a very lucky dog. >> reporter: perhaps no one is more glad that murray is safe and okay than 2-year-old jacob,

his best friend and constant companion. >> it's really amazing. >> reporter: in northwest, darcy spencer, news4. a body has been found in a fairfax county park this afternoon by someone searching for a missing teenager bryan glenn. the body was located off a path just beyond the area where police and bloodhounds searched last week. police have not positively identified the body. the high school student disappeared a week ago after dropping his brother off at the school. the next time you ride metro, you may see these ads. some are saying they're anti-muslim. the ads are sponsored by the american freedom defense initiative. the ad refers to a war between civilized man and, quote, the savage. metro initially held off putting them up for concern that they'd spark violence. mitt romney is campaigning

in virginia again today during a foreign policy address. he said the middle east has become more dangerous since president obama took office. in an apparent response, the presidential election team released an ad that harsh criticizes romney's foreign policy experience. but the president ignored romney's speech today during his visit to california. election day is just a month away in virginia. senate race is one of the most highesprofile races in the country. tim kaine and george allen will be facing off in a debate tonight. live near richmond with a look at how each candidate hopes to gain an edge in this close contest. >> reporter: well, first you might get a little chuckle out of this. i'm standing alongside sesame street lined with campaign signs because a pbs station is televising the debate. it will also be shown in tv

markets across virginia. that's why there's so much at stake tonight for tim kaine and george allen. both will try to win over the small percentage of undecided voters out there. this was the televised face-off between democrat tim kaine and republican george allen in fairfax county a few weeks ago. allen charged senator kaine would turn to tax hikes to battle the deficit. while kaine accused allen of hollow promises void of specifics. tonight's moderator said the tax discussion will undoubtedly emerge again. >> allen said the tax cuts should be for everyone, tim kaine says in fact that families making over $500,000 should have their tax rates raised back to where they were when bill clinton was president. so taxes is going to be a clear distinction here. >> reporter: both candidates put up new ads today.

. >> we're a great team. we'll be a great team in washington. >> reporter: allen's latest ad focuses on the looming budget cuts that could hit hard in the defense industry. >> george allen's plan stops the defense cuts, creates jobs, and grows our economy. >> reporter: while kaine has outraised allen, outside groups have spent tens of millions of ads against kaine. polls have been mostly deadlocked until the last few days when three surveys show kaine pulling ahead. swing voters they say might vote a split ticket. >> the vast majority of people who vote for barack obama are going to vote for tim kaine, same is true of the people who vote for mitt romney will vote for george allen. both candidates are really looking for those potential crossovers, potential switchover voters. >> reporter: now, that debate sartz starts at 8:00 tonight.

i'll have a full report on news4 at 11:00. julie carey, news4. we have breaking news out of pennsylvania tonight. jerry sandusky is speaking out hours before he is scheduled to be sentenced on those sexual abuse charges. sandusky maintains his innocence in the statement that was released just moments ago and says, quote, they can treat me as a monster, but they can't take away my heart. in my heart, i know i did not do these alleged disgusting acts. sandusky will be sentenced tomorrow after being convicted in june on 45 counts of child sexual abuse. the police are investigating an extreme case of bullying at a school in southern virginia. six male students in castlewood, virginia, are accused of sexually assaulting other high school students off school property. police believe it's been going

on since back in may. they've been allowed back in class, but will appear in juvenile court tomorrow. parents kept their kids home from school because they were afraid for the safety of their children. firefighters spent this afternoon fighting fire on the campus of the university of virginia. those flames broke out at an indoor practice facility built for uva's football team. it happened about 12:30 this afternoon. officials say construction crews were working on the building when the fire started. it took firefighters about an hour and a half to get those flames under control. nobody was injured. next month, maryland voters will decide whether same-sex couples can legally get married. today a new batch of ads for and against the measure hit the airwaves. as chris gordon reports, even a few local nfl stars are voicing their opinions. >> marriage, the union of a man and a woman. >> the maryland marriage alliance is launching its tv ad campaign urging people to vote against question 6.

the civil marriage protection act. >> everyone is entitled to love and respect. but nobody's entitled to redefine marriage. >> the question 6 redefines marriage as we know it, and we're saying we think marriage is valuable to society, that is more than about what any two adults want. >> reporter: in past maryland elections, political media buzz focused on the baltimore market of radio and tv. but on the issue of question 6, both sides realize that half the maryland voters are in the washington suburbs, and so you will be seeing and hearing a lot of ads. >> question 6 does not in any way interfere with my religion, it doesn't threaten my catholic faith, and it is the right thing to do for all marylanders. on november 6th, please vote for question 6. >> reporter: this is the new web ad for marylanders for marriage equality. they want to reach the washington audience and sent out this urgent e-mail today asking supporters to donate whatever they can. they are also bringing out some big names. >> tonight the governor is going

to be meeting with brendan ayanbadejo, baltimore ravens linebacker and supporters. they'll be watching a football game and having the time to thank supporters. >> ravens center matt burk is against gay marriage and the most influential group in this debate may be the clergy. >> absolutely critical. the preachers, the clergy, throughout prince george's county and surrounding parts are critical in this fight. >> while we've heard from the clergy on both sides of the issue, some understand question 6 is really about equality, about fairness, and everybody should be treated equally under the law, we also know there are clergy undecided on the issue and some who oppose the issue. >> reporter: if the act is approved by voters, same-sex marriage will be legal in maryland on january 1st of next year. chris gordon, news4. milestone celebration for columbus day here in the district. this is the 100th anniversary of the statue and fountain outside union station.

tonight california skyrocketing gas prices are expected to easing a bit. an idle refinery resumed production today. the governor has also ordered

refineries be allowed to make the less expensive winter blend gas earlier than usual. in some places, gas prices in california have surpassed the $5 mark. experts are blaming refinery and pipeline problems for that increase. however, today senator diane feinstein ordered a federal investigation because of concerns that market manipulation is to blame for this increase. the long road to recovery in henryville, indiana, is getting a big boost this week thanks to habitat for humanity and more than 1,000 volunteers. a week-long building blitz will build ten brand-new homes for people who lost their homes in that tornado back in march. it was an f-4 tornado, part of a massive outbreak that left dozens of people dead across several states. henryville was one of the places that was hit the hardest. this week, though, thanks to about 1,200 volunteers, it's all about to change. >> you see the families, you get
